This paper discusses methodological issues of two recent experiments conducted by Christopher Bartel, and Elzė S. Mikalonytė and Vilius Dranseika, respectively, about the repeatability and individuation of musical works. I argue, first, that the reliability of their results about people’s intuitions in our everyday musical practices can be questioned due to the use of descriptions instead of musical stimuli of the works and performances involved in the cases tested. This procedure is prone to place participants in an epistemic situation in (...) which their mental capacities for their everyday judgments are not deployed and makes their judgments more vulnerable to the problem of “filling in”. I provide empirical data of an experiment that implements musical stimuli, obtaining large effect sizes regarding the results obtained by Bartel, Mikalonytė and Dranseika. In addition, I argue that the results of three scenarios of the experiment conducted by Mikalonytė and Dranseika are suspicious of being influenced by presentation effects that favor the contextualist intuition that the composer is a relevant parameter in work-individuation. Formal and superficial aspects of the description of their cases would cause these effects. I supply empirical data of an experiment that neutralizes those effects, obtaining moderate and large effect sizes regarding the results of Mikalonytė and Dranseika. (shrink)

Observers who note the increasing popularity of bioethics discussions often complain that the social sciences are poorly represented in discussions about things like abortion and stem-cell research. Critics say that bioethicists should be incorporating the methods and findings of social scientists, and should move towards making the discipline more empirically oriented. This way, critics argue, bioethics will remain relevant, and truly reflect the needs of actual people. Such recommendations ignore the diversity of viewpoints in bioethics, however. Bioethics can gain much (...) from the methods and findings from ethnographies and similar research. But it is misleading to suggest that bioethicists are unaware of this potential benefit. Not only that, bioethicists are justified in having doubts about the utility of the social science approach in some cases. This is not because there is some inherent superiority in non-empirical approaches to moral argument. Rather, the doubts concern the nature of the facts that the sciences would provide. Perhaps the larger point is that disagreements about the relationship between facts and normative arguments should be seen as part of the normal inquiry in bioethics, not evidence that reform is needed. Guy Rohrbaugh and Allan Hazlett have provided two arguments against the thesis that musical works are types. In short, they assume that, according to our modal talk and intuitions, musical works are modally flexible entities; since types are modally inflexible entities, musical works are not types. I argue that Rohrbaugh’s and Hazlett’s arguments fail and that the type/token theorist can preserve the truth of our modal claims and intuitions even if types are modally inflexible entities. First, I consider two alternatives (...) for the type/token theorist proposed in recent literature about the topic: the created types’ solution and the created abstract objects’ solution. I argue that none of them is attractive for the type/token theorist because they do not preserve the theoretical advantages of type/token theories to explain musical works’ repeatable nature. Then, I focus on the arguments’ common premise that musical works are modally flexible entities. A deeper analysis of musical practice will show that this premise is not true: our modal claims do not imply that musical works could have had different intrinsic but, instead, extrinsic properties. Finally, I show how the nested types theory may offer a satisfactory explanation of this fact and how it captures the truth of our modal talk about musical works. (shrink)

It is commonly assumed that moral deliberation requires that the alternatives available in a choice situation are evaluatively comparable. This comparability assumption is threatened by claims of incomparability, which is often established by means of the small improvement argument (SIA). In this paper I argue that SIA does not establish incomparability in a stricter sense. The reason is that it fails to distinguish incomparability from a kind of evaluative indeterminacy which may arise due to the vagueness of the evaluative comparatives (...) ‘better than,’ ‘worse than,’ and ‘equally as good as.’. Background: Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals. Aim: To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations. Methods: Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group. Ethical considerations: Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research. Result/conclusion: Two categories emerged: one in ‘ethical issues’ (...) and one in ‘emotions and feelings in caring’. The four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

According to the mainstream view in the philosophy of music, the only way to authentically perform works of past centuries is according to the ideal of Historically Authentic Performance (HAP). This paper aims to show that, despite recent defences of the mainstream view, it lacks motivation, and hence should be abandoned or revised. As we shall see, first, there is no plausible account of HAP as a final and intrinsic value consistent with the work-focused teleology of work-performance. Second, a plausible (...) account of the value of HAP in work-performance regards HAP as a way of performing works of past centuries convincingly. However, this approach does not support the mainstream view because this only leaves HAP as an interpretive option. Finally, an alternative defence of the value of HAP in the form of an indispensability argument is considered: HAP is indispensable to accurately comply with a work’s score, and thus to perform it faithfully. This strategy supports the demands of the mainstream view, but we will see that, if we take this option seriously, HAP must be understood in a substantively different manner than the mainstream view does, such that it ultimately amounts to the second option analysed above. The determination thesis is the idea that art-ontological facts are determined by the folk ontological conception of artworks embedded in our artistic practices. From this thesis, descriptivism in the metaontology of art has been often characterized as the view that the task of art-ontology is to describe that folk conception. Amie Thomasson and Andrew Kania provide two paradigmatic accounts within this path. In this paper, I argue that this descriptivist approach is ungrounded because the determination thesis suffers from presupposition failure. (...) It presupposes that, whenever there is a practice of producing and appreciating artworks, there is also a folk ontological conception about those artworks. This presupposition, an implicit premise in Thomasson's and Kania's accounts, will be revealed as false, paying attention to the way artistic practices have evolved. I will conclude that descriptivism should abandon this approach and embrace metaontological realism if it aims to be a plausible view. (shrink)

The development and use of advanced and innovative neuroscience, neurotechnology and some forms of artificial intelligence have exposed potential threats to the human condition, including human rights. As a result, reconceptualizing or creating human rights (i.e. neurorights) has been proposed to address specific brain and mind issues like free will, personal identity and cognitive liberty. However, perceptions, interpretations and meanings of these issues—and of neurorights—may vary between countries, contexts and cultures, all relevant for an international-consensus definition and implementation of neurorights. (...) Thus, we encourage reflecting on the proactive inclusion of transnational, cross-cultural and contextual considerations and concerns to contribute to the global discourse. This inclusion does not mean endorsing ethical relativism but rather a call to foster a universal understanding of key concepts and concerns. Including contextual and cultural perspectives may truly anticipate global concerns which could be addressed while developing and implementing neurorights. Consequently, any ethical and/or legal regulatory framework(s) for the translational and transnational use of advanced neuroscience, neurotechnology and some forms of artificial intelligence intended to protect and safeguard human dignity should be contextually and culturally mindful, responsible, respectful and inclusive of not only human rights and fundamental freedoms but also of neurocognitive cultural diversity. We discuss ethical aspects of risk-taking with special focus on principlism and mid-level moral principles. A new distinction between the strength of an obligation and the degree to which it is valid is proposed. We then use this distinction for arguing that, in cases where mid-level moral principles come into conflict, the moral status of the act under consideration may be indeterminate, in a sense rendered precise in the paper. We apply this thought to issues related to pandemic influenza vaccines. (...) The main conclusion of the paper is that on a principlist approach some acts may be neither right nor wrong (or neither permissible nor impermissible), and we claim that this has important implications for how we ought to make decisions under risk. Este artículo de investigación explora los factores relacionados con el cambio social por la educación en jóvenes en contextos de pobreza y marginación en Veracruz. Para tal efecto, recupera datos del levantamiento de información de un proyecto sobre jóvenes mediante un enfoque cualitativo realizado en ciudades medias de ese estado, en el cual se estudiaba la participación política de los jóvenes, pero el tema educativo era muy importante para comprender las trayectorias juveniles. Nuestro artículo es derivado de la investigación “Promover (...) espacios para la participación cívica, la inclusión y la reducción de la Violencia” patrocinado por el IDRC (Centro Internacional de Investigaciones para el Desarrollo de Canadá). La cual se enfocó en la inclusión social y la ciudadanía de los jóvenes en entornos de violencia, vulnerabilidad y exclusión en el estado de Veracruz. Se llevó a cabo en colaboración con la Universidad Veracruzana, el Centro de Servicios Municipales (CESEM) y el Movimiento de Apoyo a Niños Trabajadores y de la Calle (MATRACA-AC) durante al 2017 al 2020. El levantamiento del proyecto del cual recuperamos datos para este trabajo consistió en 20 grupos focales, 46 entrevistas a jóvenes y 14 a docentes en Xalapa, Coatzacoalcos, Veracruz y Poza Rica ciudades del Estado de Veracruz. Los datos indican que, al menos, existen cinco factores que constriñen los proyectos educativos juveniles: ingreso familiar, aspiraciones, contexto social, redes sociales y apoyo docente. Estos elementos de combinación contingente determinan las trayectorias juveniles individuadas en el campo escolar y pueden explicar tanto la permanencia como el abandono de la escuela en estas ciudades. _Winner of the Fabian Dorsch ESA Essay Prize._ Julian Dodd defends the view that, in musical work-performance practice, interpretive authenticity is a more fundamental value than score compliance authenticity. According to him, compliance with a work’s score can be sacrificed in cases where it conflicts with interpretative authenticity. Stephen Davies and Andrew Kania reject this view, arguing that, if a performer intentionally departs from a work’s score, she is not properly instantiating that work and hence not producing an authentic performance (...) of it. I argue that this objection fails. A detailed analysis of work-performance practice reveals, first, that the normative scope of interpretive authenticity encompasses the practice of composing musical versions and that, second, when performers sacrifice score compliance to maximize interpretive authenticity, they are performing the target work by means of performing a version of it. By means of the nested types theory, I then show how performances produced in this way can be properly formed instances, and hence authentic performances, of their target work. (shrink)

Impure Eliminativism about Categories is the idea that ontological categories are not wholly eliminable insofar as they have epistemic value to understand the nature of ordinary and scientific objects. From the perspective of Impure Eliminativism, different criticisms have been addressed to substantialist approaches in metaphysics and, in particular, to John Heil’s substance-mode two-category ontology. The aim of this paper is to contribute to this critical project by extending its scope to C. B. Martin’s substantialism. The thesis I defend is that (...) Martin’s substratum-trope two-category ontology satisfies the elimination criterion of Impure Eliminativism for ontological categories because either it is inconsistent or else it supplies a non-exhaustive and non-exclusive categorization of ordinary and scientific objects and their properties. First, I introduce Impure Eliminativism and its novel elimination criterion for ontological categories, and I survey recent criticisms of substantialism from that perspective. Second, I show that nothing satisfies Martin’s definition of substratum in a way that is consistent with Martin’s view on tropes. Third, I note that the attempts to avoid the inconsistency make the categorization supplied by Martin’s ontology either non-exhaustive or non-exclusive. I then conclude that Martin’s substratum-trope categorial system should be eliminated in accordance with the criterion of categorial elimination of Impure Eliminativism. (shrink)

En este artículo, se presenta una crítica ético-política hacia una propuesta tecnológico-militar que llamaremos “Corredor Energético-Militar México-Estados Unidos”. Nuestro enfoque será el medioambiente y cómo este podría ser afectado por el Corredor Energético-Militar México-Estados Unidos, pero la migración también se tendrá en cuenta. Mientras se dé la lógica del desarrollo económico con el estilo universal en la arquitectura y una estrategia militar basada en la supuesta seguridad nacional estadounidense, habrá consecuencias ecológicas negativas hacia el medioambiente y la dominancia económico-militar estadounidense (...) continuará en esta frontera internacional. Esto tiene consecuencias para la migración y aunque estas dependen de posibles modificaciones a la infraestructura futura y sus reglamentos gubernamentales, la propuesta actual no favorece a la migración. Fundamentalmente, si el Corredor Energético-Militar México-Estados Unidos es construido en su esquema actual, las consecuencias migratorias del norte de México hacia el sur de Estados Unidos serán negativas. Consistent valuation and societal prioritization of risks presupposes comparability among risks, that is, in order to rank risks in order of severity, and allocate risk preventative resources accordingly, we must be able to determine whether one risk is better or worse than another, and by how much. It is often claimed, however, that some risks are not amenable to this kind of comparison because they are incommensurable, which roughly means that they are not comparable with respect to a common (...) cardinal measure. The aim of this thesis is to i) consider what it means to say that two risks are incommensurable, ii) explore if incomparability - comparison failure with respect to a common ordinal scale - ever occurs, and how to model it if it does. Essay I is a critical examination of the most prominent argument for incomparability, the so-called small improvement argument. It is argued that the argument fails because it conflates incomparability and a kind of evaluative indeterminacy. Essay II outlines so-called margin of error principles for comparative value judgements. They are based on the idea that if a proposition concerning the value relation between two value-bearing options is true, but there are sufficiently similar cases in which it is false, it is not available to be known. The usefulness of these principles is demonstrated by utilizing them in an epistemological case against SIA. Essay III presents a novel account of incomplete preference orderings which acknowledges that incomparability can vary in degrees. This is achieved by means of a probabilistic analysis of preferences. (shrink)

Se expresa, por ejemplo, en la frase de Lucrecio: “Nada surge de la nada ni va hacia la nada”. Todo lo que existe es efecto de una red de causas y es a su vez causa de otras cosas. Se sigue que la teoría científica orientada hacia la inteligibilidad —diferente de la ciencia positi-vista y pragmática— (...) es la búsqueda de determinismo causal. El desarrollo de esta tesis utiliza como hilo conductor el pensamiento de René Thom. Esto significa que el determinismo causal se examina en su rela-ción con (I) la estabilidad y la inestabilidad, (II) el desafío de la mecánica cuántica, (III) las raíces aporéticas de la ciencia tal como la dualidad determinismo-indeterminismo, y finalmente (IV) en su relación con el método para ponerlo de manifiesto, es decir la reducción de lo posible —estrategia que es, en este dominio, una de las ideas más originales de Thom.The main thesis of this essay is that causal determinism is a property of nature and the main principle of natural intelligibility. It can be expressed in Lucretius’ words: “Nothing comes out of nothing or passes into nothing”. Everything is the effect of a web of causes and is, in its turn, cause of something else. It follows that the essence of an intelligibility-oriented scientific theory —which is different from science in a positivist or pragmatist sense— is the search for causal determinism. The development of this thesis is guided by René Thom’s thought. This means that causal determinism is analysed, first, in its relation to stability and instability; second, in its relation to the prima facie indeterminism of quantum mechanics; third, in its relation to the aporetic roots of science such as the duality determinism —indeterminism, and, finally, in its relation to the method which allows science to follow the causal determinist ideal: the reduction of the possible— a strategy which is, in this field, one of Thom’s most original ideas. Indecent Theology has provided both Feminist Theology and Liberation Theology with new contours for rethinking bodies, power, dominance, and submission. With regard to the logic of dominance that radically pushes the margins of the margins into a form of inexistent living, I suggest a material turn to rethink the contours that are evoked with Indecent Theology. Materialism has long stood as a philosophy opposing the overwhelming dominance of language and the poststructuralist emphasis that has emerged as the ‘linguistic turn’. Considering (...) ‘new materialism’ as a theoretical platform to reread Indecent Theology provides theologies and ethics an opportunity to re-imagine indecent methodologies through indecency, a sort of ethical perversion. I suggest an indecent turn in mobilizing materialism and kink as theories to reread indecent theology for a productive queer materialist sexual theology. The feminist liberation theology of Marcella Althaus-Reid pushes both feminism and liberation into new contours of power and submission and initiates new contours of queer sexuality into the discourse. When analysing Althaus-Reid’s work, we are brought to attention to the margins of the margins, an awareness of the struggle for power and control by those deemed less than. There are contours of power at and in the margins of the margins, those who occupy ‘bottom space’. From a kink/bdsm orientation, I propose to reread Alrhaus-Read’s feminist liberation theology as decolonial erotics that helps to generate a productive materialist queer sexuality. The overarching methodology of this article is a quasi-auto ethnographic investigation into the ways in which the contours of race, class, gender, sex, sexuality, and ability affect power and submission and in turn reframes both queer theology and queer sexuality that is rooted in the living out of a very particular theology and ethics, which is rooted in queer relating. Theology can neither materialize in a vacuum nor in isolation. An indecent turn to a queer sexual theology that is rooted in a queer relationality demands attention to the interdependence of queer relating that is materialized through the interdependency of the growing queer desires of bodies, power, dominance, and submission. This paper is devoted to face recent views in the ontology of music that reject that musical works are repeatable in musical performances. It will be observed that musical works’ repeatability implies that they are audible and variable in their performances. To this extent, the aim here is to show that repeatability, audibility and variability are ontologically substantive features of musical works’ nature. The thesis that will be defended is that repeatability, audibility and variability are dispositional non-aesthetic properties of musical (...) works. The plausibility of the dispositional account of musical works’ repeatability, audibility and variability will lead us to the conclusion that they are ontologically substantive features of musical works’ nature, and consequently, any suitable explanation of the ontology of musical works must not ignore them. Throughout our entire evolutionary history, the physical environment has played a significant role in shaping humans’ subsistence adaptations. As early humans began to colonise novel biomes and construct ecological niches, their behavioural flexibility appeared as an unquestionable fact. During the Late Pleistocene-Holocene transition, the shift from foraging to farming radically altered ecosystem services, resulting in increased exposure to zoonotic pathogens and the emergence of structural inequalities that pervade our current human condition in the Anthropocene epoch. The article seeks to use (...) an anthropological biosocial analysis to explore the diverse evolutionary paths humans have taken, which in turn shape their relationships with the natural world. Given the enigmatic nature of human behavior, it is essential to examine it holistically to understand how different subsistence patterns (e.g., intensive agriculture, foraging, and horticulture) have influenced resilience and adaptation to environmental challenges. Disability is often defined as deviation from putative norms of physical, cognitive, or affective function. This definition is normatively laden, causing people with disabilities to be thought of as “different” and treated with pity. We address the predominant theme of this issue on “Disability Identity”: defining and imposing the category of “disability” and attempting to overcome it through medical intervention. The issue culminates in a call for courageous humility as the proper response to encounters with disability, providing medical professionals with (...) the disposition to resist medicine’s inherent drive to fix what is perceived to be broken—that which strays from the norm. We hope that this issue might act as a clarion call to medical professionals to reevaluate how they see and interact with “disability” as a category, and ultimately with people with disabilities, especially with respect to what may be owed to persons with disabilities from society. Open Letter to Comrade Žižek is an attempt to question and highlight some incongruous points that Slavoj Žižek, one of the greatest critics of capitalism and its ideological effects in the contemporary world, expressed in his latest books about the Pandemics. The text focuses in the economic, political, social and cultural consequences of Žižek’s position and goes further in developing another position related to the spread of COVID-19 and the preventive measures to fight it.

The reinforcement sensitivity theory proposes that neurobiological systems mediate protective and appetitive behaviours and the functioning of these systems is associated to personality traits. In this manner, the RST is a link between neuroscience, behaviour, and personality. The theory evolved to the present revised version describing three systems: fight-flight-freezing, behavioural approach/activation, and behavioural inhibition. However, the most widely available measure of the theory, the BIS/BAS scales, only investigates two systems. Using a large longitudinal community survey, we found that the BIS/BAS (...) scales can be re-structured to investigate the three systems of the theory with a BIS scale, three BAS scales, and a separate fight-flight-freezing system scale. The re-structured scales were age, sex, and longitudinally invariant, and associations with personality and mental health measures followed theoretical expectations and previously published associations. The proposed framework can be used to investigate behavioural choices influencing physical and mental health and bridge historical with contemporary research. (shrink)

Some things have positive value and some things have negative value. The things with positive value are good and the things with negative value are bad. There are also things in-between that are neither good nor bad, which are neutral. All in all, then, there are three monadic value predicates: “good,” “bad,” and “neutral.”.

Carl Schmitt, one of the most influential legal and political thinkers of the twentieth century, is known chiefly for his work on international law, sovereignty, and his doctrine of political exception. This book argues that greater prominence should be given to his early work in legal studies. Schmitt himself repeatedly identified as a jurist, and Hugo E. Herrera demonstrates how for Schmitt, law plays a key role as an intermediary between ideal, conceptual theory and the messiness and complexity of (...) practical, concrete situations. Law is concerned precisely with balancing the extremes of theory and reality, and in this respect, Schmitt associates it with philosophical thinking broadly as being able to understand and explain the tensions in human experience. Reviewing and analyzing prevailing interpretations of Schmitt by Jacques Derrida, Heinrich Meier, and others, Herrera argues that the importance of Schmitt's legal framework is both significant and overlooked. En principio, bajo los términos de la doctrina de la state action la conducta discriminatoria de los particulares quedaría fuera del ámbito de aplicación de la cláusula de igual protección de la Decimocuarta Enmienda, debido a que ésta sólo es aplicable frente a la acción del Estado. Nos preguntamos si (...) es posible constatar la existencia de espacios intermedios entre el derecho público y privado, en los que se produce la vigencia frente a terceros de los derechos fundamentales. In order to highlight the significance of the book I'm reviewing here, let me recount a recent academic experience: A conference on the Zhuangzi is hosted by a leading scholar in the field with the sponsorship of a major university in mainland China. Several prominent scholars present papers focusing on various different passages of the text. The addresses cover the mystical, the performative, the epistemological, the ethical and several other facets of Zhuangzian thought. Yet one topic is conspicuous by its (...) absence: the political. Not a single paper addresses this matter. Romain Graziani's book effectively rectifies this situation by perceptively showing how Zhuangzian thought ran counter to many of the political... (shrink)

El capital social, si bien corresponde a una categoría nacida de la economía política clásica y, en particular, empleada por Karl Marx, en su versión contemporánea se muestra en la combinación del capital físico y el capital humano en el contexto de la teoría de la economía de bienestar. En la primera parte se expone la cuestión conceptual y en la segunda se expone el capital humano en un modelo de crecimiento de Convergencia. Se consideran los niveles de escolaridad promedio (...) en los asentamientos irregulares de la Delegación Milpa Alta en el Distrito Federal entre 2000-2005 y se proyectan las tasas al 2020 que mantiene los resultados de Convergencia obtenidos en el modelo para el 2000-2005, demostrando la relación entre valor, trabajo, educación y crecimiento.
